Bethany Herbertson

Bethany undertakes work across a range of areas, including General Commercial Litigation, Contentious Probate, Commercial and Residential Property Litigation, Professional Negligence and IP.

Bethany is an experienced Associate in our Dispute Resolution team, specialising in the resolution of disputes about trusts, estates and professional negligence.

Bethany is chair of the firm’s Corporate Social Responsibility committee and sits on the Graduate Recruitment committee.

Experience
Bethany's practice is predominately focused on disputes which can arise in relation to trusts, estates and claims against professionals and/or insurance companies. This includes:

  • Will validity disputes
  • Applications under the Inheritance (Provision for Family and Dependants) Act 1975
  • Claims for proprietary estoppel
  • Alleged breaches of trust
  • The contested removal of executors
  • Claims under Trusts of Land and Appointment of Trustees Act 1996, including challenging ownership shares and all dealings with co-owned property
  • Professional negligence claims including (but not exclusively) in relation to the preparation of Wills and trusts

Bethany also has a strong grounding in all matters of commercial litigation including intellectual property disputes, claims for interference with property rights, and director/shareholder disputes.

Recent cases

  • Successfully pursued a claim for a common intention constructive trust recovering the beneficial interest plus costs.
  • Assisted with a recent successful claim against a solicitor for negligent advice in relation to an asset protection trust, recovering over £200,000.
